gavel1. Who we are and agreement to these Terms

svgamaker.com and the SVGA Maker studio (the "Service") are operated by AppLooma LLC, a New Mexico limited liability company ("AppLooma", "we", "us", "our"). By creating an account, buying credits or a subscription plan, or using the Service, you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy. If you do not agree, do not use the Service.

person2. Accounts and eligibility

• You must be at least 13 years old (or the minimum digital-consent age in your country) to create an account and use the free tools.
• You must be at least 18 years old, or have the consent of a parent or legal guardian, to buy credits or a subscription plan.
• You agree to give accurate information, keep your login details private, and are responsible for all activity under your account. Tell us immediately at [email protected] if you suspect unauthorized use.
• One person or business may not create multiple accounts to collect free converts or promotional credits.

storefront3. What we sell

We sell two things, both priced in US dollars and shown on our pricing section before you pay:

• Credit packs — one-time purchases of credits (1 credit = US $0.01) used to run paid tools such as Gift Maker, Frame Maker, Themes Maker, Video To SVGA and Motion Graphics. The credit cost of each tool is shown before you run it.
• Subscription plans — recurring plans that include a monthly or yearly credit allowance and/or cloud storage for your generated assets ("Assets") in My Library/Vault, plus any other features listed on the plan at the time you subscribe.
• Shop items — ready-made digital asset packs (frames, entry animations, gifts, medals, chat bubbles, themes) sold as a one-time download with a Regular license (personal use only; no resale or redistribution) or a Commercial license (resale and redistribution allowed). The license bought is stated on the item and in the downloaded file. Files are available in Downloads in your account; each download link is personal, single-use and expires after 5 minutes.

toll4. Credits

• Credits are added to your account as soon as your payment is confirmed.
• Credits bought in a credit pack do not expire. Credits included in a subscription plan are valid for the billing period stated on the plan.
• Credits are deducted only when a generation or conversion completes successfully. Failed jobs are never charged.
• Credits are a prepaid licence to use the Service. They are not money, have no cash value, cannot be withdrawn, sold, exchanged for cash or cryptocurrency, transferred to another account, or used outside SVGA Maker.
• Free and bonus credits (for example, the +5% or +10% bonus on larger packs, or free converts for new accounts) have no cash value and are never refundable.
• When you use credits, the credits you bought in the earliest purchase are used first.

autorenew5. Subscription plans, renewal and cancellation

• Subscription plans paid by card renew automatically at the end of each billing period at the price shown when you subscribed, until you cancel. Plans paid in crypto cover one billing period and end unless you pay again.
• You can cancel any time from your account settings or by emailing [email protected]. Cancellation stops the next renewal; your plan stays active until the end of the period you have already paid for.
• We will email you before any change to the price of your plan. A new price applies only from your next renewal after the notice.
• When a subscription ends, Assets stored under that plan remain available to download for 30 days. After that we may delete them.
• Without a Vault plan, the files you generate are kept for 7 days so you can preview and download them in My Library; after 7 days they are permanently deleted.

payments6. Payments

• Card, Apple Pay and Google Pay payments are processed securely by Stripe, Inc. We never see or store your full card number.
• Cryptocurrency payments are accepted in two ways: through NOWPayments (a third-party crypto payment processor supporting multiple coins), and directly in USDT on the TRON network (TRC-20) to AppLooma LLC's own receiving address. A crypto payment counts as received only after it is confirmed on the blockchain.
• For direct USDT payments you must send the exact amount shown, in USDT (TRC-20) on the TRON network, before the payment window expires. Payments sent on another network, in another token, to another address, or in a different amount may be lost or delayed, and we are not responsible for funds sent incorrectly.
• Crypto payments buy a single credit pack or a single subscription period and do not renew automatically. Automatic renewal applies only to card subscriptions paid through Stripe.
• SVGA Maker does not provide users with a crypto wallet or crypto balance, and does not buy, sell, exchange, hold or transfer cryptocurrency for users. Crypto is accepted only as a way to pay for our services.
• All prices are in US dollars. Any amount shown in another currency (for example, Bangladeshi Taka) is an estimate only; your bank or wallet may apply its own exchange rate or fees.
• Card payments appear on your statement as SVGAMAKER.
• You authorise us, through Stripe, to charge your payment method for each purchase and each subscription renewal until you cancel.

local_shipping7. Delivery

Everything we sell is digital. Credits and subscription features are delivered to your account immediately after payment is confirmed. Generated and converted files are delivered inside the Studio and My Library, usually within 1–3 minutes, and can be downloaded in the formats offered by each tool (for example .svga, MP4, WebP, Lottie JSON, PNG). Nothing is shipped physically.

receipt_long8. Refunds

Refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. In short: an unused credit purchase, or a subscription with no stored Assets, can be refunded if you ask within 7 days of payment; once any credit from that purchase has been used, or any Asset has been stored under that subscription, the payment is not refundable.

verified9. Your content and ownership

• You keep all rights to files you upload and, to the extent permitted by law and by the terms of the underlying generation engines, to the gifts, themes and other Assets you generate.
• You give us a limited licence to store, process and deliver your files only to operate the Service.
• You are responsible for having the rights to any reference photo, video, music, logo or character you upload.
• AI output can vary and may resemble other content. You are responsible for checking that your Assets are suitable before using them commercially.

block10. Acceptable use

You must not use the Service to create, upload or distribute content that:

• is sexual, pornographic or sexually suggestive, or involves minors in any sexual or harmful context;
• shows a real person's face, voice or likeness without their consent, including deepfakes;
• uses characters, logos, brands, music or artwork you do not own or have permission to use;
• promotes gambling, weapons, illegal drugs, violence, terrorism, hate or harassment;
• is illegal, defamatory, fraudulent or violates anyone's privacy;
• violates the usage policies of our generation providers (Google, ByteDance, Alibaba); or
• attempts to probe, overload, scrape, reverse-engineer or disrupt the Service.

We may remove content and suspend or close accounts that break these rules. Credits spent on removed content, and payments for accounts closed for breach of this section, are not refunded.

balance11. Disputes and chargebacks

If something is wrong with a charge, please contact us first at [email protected] — most billing issues are resolved within 2 business days. If you open a chargeback or payment dispute for a purchase whose credits you have already used, or whose subscription Assets are stored, we may suspend the account while the dispute is reviewed and provide our records to the payment processor.

sync_alt12. Service availability and changes

The Service is provided "as is" and "as available". Generation engines, tools, features and prices may change. Price changes never reduce credits you have already bought, and subscription price changes follow Section 5.

shield13. Disclaimer and limitation of liability

To the maximum extent permitted by law, AppLooma LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the three months before the claim. Nothing in these Terms limits rights you have under consumer-protection laws that cannot be excluded.

contract14. Termination

You may stop using the Service and ask us to delete your account at any time. We may suspend or end your access if you breach these Terms. Where reasonable, we will tell you first and give you a chance to download your Assets.

account_balance15. Governing law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules. Any dispute that cannot be resolved by contacting us will be handled by the competent courts of New Mexico, unless the law of your country gives you the right to bring a claim in your local courts.

update16. Changes to these Terms

We may update these Terms. The "Last updated" date shows the latest version. For material changes we will notify you by email or in the Service. Continuing to use the Service after changes take effect means you accept them.
